
Kevin Kiley was elected to the House of Representatives in 2022 to represent the 3rd congressional district of California. Prior to his election to the United States Congress, Rep. Kiley served in the California State Assembly, and in 2020 was named National Legislator of the Year by the Association of Independent Workers. Rep. Kiley earned his undergraduate degree from Harvard University, and a JD from Yale Law School.
Why He’s Important to Agents:
Rep. Kiley introduced H.J. Res. 116, a Congressional Review Act resolution which passed in the House Committee on Education and the Workforce on March 21. PIA actively supports this initiative. Rep. Kiley’s resolution would nullify the Department of Labor’s (DOL) rule entitled “Employee or Independent Contractor Classification Under the Fair Labor Standards Act” (89 Fed. Reg. 1638), which went into effect on March 11th. The rule abandons the two core factors of the previous rule and instead relies on a combination of six different factors—an approach that injects unnecessary subjectivity and uncertainty into worker classification—to determine worker status for FLSA purposes. The new rule causes confusion and will invite frivolous litigation, both of which could dangerously stifle independent work opportunities.
PIA will continue to work with Rep. Kiley to roll back DOL’s harmful rule and protect the independent contractor workforce.
